1. About Us

This website is operated by Opulent Digital LLC, trading as Atelier Opulence.

Business address:
1209 Mountain Road Pl NE, Ste R
Albuquerque, NM 87110
United States

Email: help@atelieropulence.com

In these Terms, “we”, “us” and “our” refer to Atelier Opulence. “You” refers to the person using our website or purchasing our products.

These Terms apply to the use of our website and purchases made for delivery to the United Kingdom.

2. These Terms and Your Order

Please read these Terms before placing an order. By placing an order, you agree to the terms applicable to that purchase.

Our Shipping Policy, Returns & Refunds Policy and Privacy Policy provide additional information about delivery, returns and the handling of personal information.

Nothing in these Terms excludes or restricts your statutory rights.

We may update these Terms from time to time. Changes apply to future orders and do not retrospectively alter an existing purchase unless you agree or a change is required by law.

3. Products and Descriptions

We aim to provide accurate descriptions, photographs, specifications and size information.

Product images are illustrative. Screen settings and lighting may affect the appearance of colours, but goods supplied must still match their description and meet the standards required by law.

Please review the product description and size guide before ordering. Any stated measurement tolerance must be reasonable and does not excuse materially inaccurate descriptions or size information.

We will not substitute a materially different product, size or colour without your agreement.

Products are subject to availability.

4. Placing an Order

Before submitting your order, you will have an opportunity to review the products, quantities, delivery information and total price.

You are responsible for providing accurate contact and delivery details and for checking your order before payment.

You must be legally capable of entering into a binding contract and authorised to use your chosen payment method.

After you place an order, we will send an acknowledgement confirming that we have received it. This acknowledgement does not, by itself, constitute acceptance.

Your order is accepted, and a contract is formed, when we send confirmation that the goods have been dispatched.

If we cannot accept your order—for example, because a product is unavailable, payment cannot be verified or there is a genuine pricing error—we will inform you and promptly refund any payment taken for the unaccepted goods.

We may decline orders where there are reasonable grounds to suspect fraud or unlawful activity. This does not affect our obligations under contracts already accepted.

5. Prices, Taxes and Payment

Prices for the United Kingdom are displayed in pounds sterling (GBP / £) and include applicable taxes that we are required to collect.

Delivery charges and any optional charges are shown before you place your order. Optional extras require your express agreement.

Where goods are shipped internationally, any import charges payable by you will be clearly explained before purchase. Where a charge cannot reasonably be calculated in advance, we will explain how it may arise.

Payment is taken using the payment methods offered at checkout and is subject to authorisation by the relevant provider.

If we identify a genuine pricing error before accepting an order, we will contact you with the correct price. You may choose whether to proceed or cancel. We will not charge an increased amount without your agreement.

6. Delivery

Available delivery destinations, charges and estimated times are set out in our Shipping Policy and during checkout.

We will deliver within the period agreed when you order. Unless a different period has been agreed, we will deliver without undue delay and within 30 days of the contract being formed.

If delivery is delayed, we will provide relevant information and explain the available options. Your statutory rights concerning late or failed delivery remain unaffected.

If you provide an incorrect address, contact us promptly. We cannot guarantee that delivery details can be changed once processing or dispatch has begun. Any reasonable additional delivery cost resulting from incorrect information supplied by you will be explained before it is charged.

Goods remain at our risk until they come into your physical possession, or that of a person you identify to receive them. Different rules may apply if you independently appoint a carrier that we did not offer.

Ownership passes to you once we have received full payment and the goods have been delivered.

7. Cancelling or Changing an Order

Contact help@atelieropulence.com as soon as possible if you wish to change or cancel an order.

We cannot guarantee that an order can be amended or stopped once processing has begun. However, processing or dispatch does not remove your statutory cancellation rights.

For most online purchases, you may cancel without giving a reason from the time you place the order until 14 calendar days after the day you receive the goods.

Where goods from one order arrive separately, the cancellation period generally runs from the day after you receive the last item.

After notifying us of cancellation, you normally have a further 14 calendar days to send the goods back.

Any clear statement of your decision to cancel is sufficient. Prior approval or use of a particular form is not required to exercise this statutory right.

Further details, including applicable exceptions, appear in our Returns & Refunds Policy.

8. Our 30-Day Returns Policy

In addition to your statutory cancellation rights, we offer a 30-day return request period from delivery.

Notify us within 30 calendar days after receiving your goods and send them back within 14 calendar days after notification.

For voluntary returns requested outside the statutory cancellation period, products must meet the conditions in our Returns & Refunds Policy, including being unused, unworn apart from a brief indoor fitting, unwashed and unaltered, with original tags and supplied accessories.

During the statutory cancellation period, you may inspect and try on goods as you would in a shop. Where legally permitted, we may make a deduction reflecting actual diminished value caused by handling beyond what is necessary for that inspection.

You pay the direct cost of change-of-mind return postage, as disclosed before purchase. We cover reasonable, necessary return costs for faulty, misdescribed or incorrectly supplied goods.

Return instructions, exceptions, refund timings and exchange arrangements are explained in our Returns & Refunds Policy.

9. Faulty, Incorrect or Misdescribed Goods

Goods must be of satisfactory quality, fit for purpose and as described.

If you believe an item does not meet these requirements, contact help@atelieropulence.com with your order details and a description of the problem.

We may request reasonable evidence or arrange an inspection to assess the issue.

Your legal remedies may include a refund, repair, replacement or price reduction, depending on the circumstances. These rights are not limited to our voluntary 30-day returns period.

We do not require you to accept an exchange or store credit instead of a refund to which you are legally entitled.

10. Use of Our Website

You may use our website for lawful purposes.

You must not:

  • submit fraudulent orders or use payment details without permission;

  • introduce malicious software or attempt unauthorised access;

  • interfere with the website’s security or operation;

  • use the website to infringe another person’s rights;

  • copy or commercially exploit protected content without permission or another lawful basis.

We may restrict access where reasonably necessary to address misuse or security risks. This does not remove your rights relating to an existing order.

We aim to keep the website available but cannot guarantee uninterrupted access. Temporary maintenance or technical issues do not affect our obligations under accepted orders.

11. Our Responsibility to You

If we breach these Terms or fail to use reasonable care and skill, we are responsible for loss or damage that is a foreseeable result.

Loss or damage is foreseeable if it is an obvious consequence of the breach or was contemplated by both parties when the contract was made.

Products are supplied for domestic and personal use. We do not accept liability for business losses arising from commercial use, including loss of business profits, revenue or business opportunities, to the extent permitted by law.

Nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation;

  • breach of your statutory rights concerning goods;

  • any other liability that cannot lawfully be excluded or limited.

12. Events Outside Our Reasonable Control

Events outside our reasonable control may affect our ability to perform an order.

If this happens, we will contact you as soon as reasonably possible and take reasonable steps to reduce the impact.

This does not automatically remove our responsibility for delivery or your right to cancel and receive a refund where required by law.

If there is a substantial delay, we will explain your options under the contract and applicable consumer law.

13. Intellectual Property

Website content, including text, photographs, graphics, logos and videos, is owned by Atelier Opulence or used with permission from the relevant rights holders.

You may view and print content for personal, non-commercial use.

Other reproduction, distribution, modification or commercial exploitation requires prior permission unless permitted by law.

Nothing in these Terms transfers ownership of our intellectual property to you.

14. Personal Information

We process personal information as described in our Privacy Policy.

That policy explains how we collect and use information, the lawful bases we rely on, international transfers and your data protection rights.

Cookies and similar technologies are subject to the choices and information provided through our cookie management tools.

15. Complaints

If you have a complaint, email help@atelieropulence.com with your order number, relevant details and the outcome you are seeking.

We will investigate and seek to resolve the matter fairly.

You are not required to use an informal complaints process before exercising your statutory rights or bringing a legal claim.

16. Governing Law and Courts

These Terms are governed by the laws of England and Wales.

If you are a consumer resident elsewhere in the United Kingdom, this choice of law does not deprive you of any mandatory consumer protections applicable where you live.

You may bring proceedings concerning your purchase in the courts available to you under applicable consumer jurisdiction rules, including the courts of the part of the United Kingdom where you live.

Nothing in these Terms requires a UK consumer to bring a claim exclusively in the United States.

17. Other Important Terms

If a court finds part of these Terms unlawful or unenforceable, the remaining provisions will continue to apply where they can operate independently.

A delay in enforcing a right does not mean that the right has been waived.

We may transfer our rights and obligations only where this does not reduce your contractual guarantees or adversely affect your consumer rights.

No person other than you and us has a right to enforce these Terms, except where applicable law provides otherwise.
